Terms of Service

These terms set the ground rules for using Great Hire’s recruiting, communications, analytics, and integration services.

Agreement and scope

These Terms of Service (the “Terms”) are a binding agreement between Catapult AI, LLC (dba “Great Hire”) (“Great Hire,” “we,” “us,” or “our”), and the person or organization that accesses or uses our websites, applications, APIs, AI-assisted recruiting tools, calling and messaging features, and related services (collectively, the “Services”).

Catapult AI, LLC is a Delaware limited liability company formed on October 24, 2025 (Delaware file number 10378977). Great Hire is its trade name.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Services.

An order form, statement of work, data processing addendum, business associate agreement, or other written agreement signed by Great Hire may add to or modify these Terms. If there is a conflict, the signed agreement controls for that conflict.

Accounts and eligibility

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate account information, protect credentials and API keys, and promptly notify us of suspected unauthorized access.
  • You are responsible for activity under your account and for configuring roles, permissions, integrations, consent flows, and retention settings appropriately.
  • You may not share accounts except through features intended for authorized team access, and you may not use another person’s account without permission.

Customer data and responsibilities

“Customer Data” means data that you or your authorized users submit, connect, generate, transmit, or instruct us to process through the Services. It may include job information, applicant and candidate records, resumes, contact details, interview content, call recordings, transcripts, messages, notes, rubrics, scorecards, integration data, and recruiting outcomes.

As between you and Great Hire, you retain your rights in Customer Data. You grant us a worldwide, non-exclusive, limited license to host, copy, transmit, display, transform, and otherwise process Customer Data only as needed to provide, secure, support, and improve the Services; comply with your instructions; and meet legal obligations.

You are responsible for:

  • having all rights, notices, permissions, consents, and lawful bases needed for us and our service providers to process Customer Data as you direct;
  • complying with employment, labor, anti-discrimination, accessibility, privacy, biometric, consumer-reporting, telemarketing, call-recording, and communications laws that apply to your use;
  • giving applicants and candidates clear notices about your recruiting practices, AI-assisted tools, recordings, and data retention where required; and
  • reviewing Customer Data for accuracy and responding to requests from individuals whose information you control.

Great Hire generally acts as your service provider or processor for Customer Data you place in the Services. You remain the employer, staffing firm, recruiter, or other organization responsible for determining why and how that data is used.

Calls, texts, recordings, and email

The Services may initiate or receive phone calls, use an AI-generated or synthetic voice, send or receive text messages and email, transcribe communications, and record calls when configured. Communications may be delivered through providers such as Twilio, Telnyx, Resend, LiveKit, and telecommunications carriers.

Your obligations

  • Contact only people you are legally permitted to contact, for permitted purposes, and maintain evidence of consent where consent is required.
  • Clearly identify yourself and your organization and, when applicable, disclose that a person is speaking with an automated or AI-assisted system.
  • Before recording or transcribing, provide legally sufficient notice and obtain all consent required in every applicable jurisdiction.
  • Honor do-not-call, revocation, unsubscribe, and suppression requests promptly, including recognized text-message keywords such as STOP.
  • Do not use the Services for spam, unlawful autodialing, deceptive caller ID, purchased contact lists without a lawful basis, or prohibited high-risk traffic.

Recipient disclosures

Message frequency varies. Message and data rates may apply. Reply STOP to an applicable text thread to opt out and HELP for help, or contact the organization identified in the message. Delivery is not guaranteed and may depend on carriers and network availability. Consent to receive marketing communications is not a condition of purchasing goods or services.

A call recipient may end a call at any time and may request follow-up by a human. Great Hire does not require a candidate to complete an AI-assisted interaction as a condition of exercising rights provided by applicable law.

AI-assisted features and hiring decisions

The Services may use artificial intelligence to conduct or support screening conversations, transcribe calls, summarize information, recommend questions, extract job or candidate details, identify possible inconsistencies, and generate scores, flags, drafts, or other outputs (“AI Output”).

AI Output can be incomplete, inaccurate, outdated, or inappropriate for a particular decision. It is decision-support information, not legal, employment, medical, or professional advice. You must independently review material AI Output and must not use it as the sole basis for a hiring, firing, compensation, promotion, eligibility, or other decision that has a legal or similarly significant effect where prohibited.

You are responsible for validating job-related criteria, providing reasonable accommodations, monitoring for discriminatory impact, giving any required automated employment decision-tool notices, and providing human review or appeal where required. You may not use the Services to infer protected characteristics or make decisions based on them.

Acceptable use

You may not, and may not enable anyone else to:

  • violate law, regulation, court order, these Terms, or another person’s rights;
  • harass, threaten, discriminate, deceive, impersonate, defraud, or exploit any person;
  • upload malware; probe or disrupt the Services; bypass access, rate, safety, or security controls; or access data outside your authorized tenant or scope;
  • reverse engineer, scrape, copy, resell, or create a competing service from the Services except where applicable law expressly permits it;
  • use Customer Data or AI Output to train a competing model or service without the data owner’s permission;
  • process sensitive data, protected health information, payment-card data, government identifiers, or biometric identifiers unless a signed agreement with Great Hire expressly permits it and you have implemented required safeguards; or
  • use voice generation to clone or impersonate a person without their prior express authorization.

We may investigate suspected violations and limit or suspend traffic that threatens people, provider networks, the Services, or our legal compliance.

Third-party services and integrations

You may connect the Services with third-party products, including identity, analytics, communications, email, AI, applicant-tracking, calendar, spreadsheet, storage, and collaboration services. Examples may include Google, PostHog, Twilio, Telnyx, Resend, OpenAI, LiveKit, Airtable, Crelate, and Slack.

If you enable an integration, you direct us to exchange the data reasonably necessary to provide it. Third-party services are governed by their own terms and privacy policies, and Great Hire is not responsible for a third party’s independent acts, availability, or changes. You are responsible for maintaining authorized third-party accounts and complying with their terms.

You can disconnect supported integrations through the applicable provider or Great Hire account controls. Disconnecting may stop future transfers but may not delete data already lawfully processed or retained under an agreement or legal obligation.

Fees and subscriptions

Paid Services, usage limits, subscription periods, and fees are described in the applicable order form or checkout flow. Unless stated otherwise, fees are in U.S. dollars, exclude taxes, and are non-refundable except as required by law or expressly stated in a signed agreement.

Usage-based charges may include calling, messaging, storage, transcription, AI, or other provider costs. You authorize us to charge the payment method on file for undisputed amounts when billing is enabled. Overdue amounts may result in suspension after any notice required by the applicable agreement or law.

Ownership and licenses

Great Hire and its licensors own the Services, software, designs, documentation, models, workflows, and related intellectual property, excluding Customer Data. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services during your authorized term.

If you provide feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation. We may use aggregated or de-identified information that does not reasonably identify you, your organization, or an individual to operate, secure, analyze, and improve the Services.

Confidentiality, privacy, and security

Each party may receive non-public information identified as confidential or that a reasonable person would understand is confidential. The receiving party will protect it using reasonable care, use it only for the relationship, and disclose it only to people who need it and are bound by confidentiality obligations. These duties do not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source.

We use reasonable administrative, technical, and organizational safeguards designed to protect the Services. No system is completely secure, and you are responsible for appropriate endpoint, identity, access, and integration security. Our processing of personal information is described in the Privacy Policy and any applicable data processing addendum.

Suspension and termination

You may stop using the Services at any time. Subscription cancellation and the effect of termination are governed by the applicable order form. We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, fail to pay undisputed fees, or use the Services in a way that may harm a person, provider network, or the Services. When reasonable, we will give notice and an opportunity to cure.

After termination, your license ends. We may delete Customer Data according to our retention practices and applicable agreement, subject to legal holds and backup cycles. You are responsible for exporting data you need before termination. Sections that by their nature should survive—including ownership, confidentiality, disclaimers, liability limits, and general terms—will survive.

Disclaimers

To the maximum extent permitted by law, the Services and AI Output are provided “as is” and “as available.” Great Hire disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or suitable for every jurisdiction or employment decision; that communications will be delivered; or that AI Output, transcripts, integrations, or third-party data will be accurate or complete. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, even if advised that such damages are possible.

Great Hire’s total aggregate liability arising out of or related to the Services will not exceed the amounts you paid to Great Hire for the Services giving rise to the claim during the 12 months before the event giving rise to liability, or $100 if you used only free Services.

These limitations do not apply where prohibited by law and do not limit liability that cannot lawfully be limited. A signed agreement may provide different limits.

General terms

  • Changes. We may update these Terms. We will change the effective date and provide additional notice when required. Continued use after an update takes effect means you accept the revised Terms.
  • Governing law and venue. The governing law and forum in a signed order form control. If no signed agreement states them, these Terms and any dispute arising from them or the Services are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The state and federal courts located in Delaware will have exclusive jurisdiction, and each party consents to their personal jurisdiction and venue, except where applicable consumer law requires otherwise.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, financing, or sale of all or substantially all relevant assets.
  • Notices. We may provide notices through the Services, by email, or to the contact information associated with your account. Legal notices to Great Hire must be sent to [email protected]. Service of process must be directed to our registered agent at the address below, unless applicable law permits another method.
  • Entire agreement. These Terms and incorporated agreements are the entire agreement about the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver.
